Service and Payment Agreement

Terms & Conditions

Take the time to read this, please. 

You’ll get way more out of your coaching session and it’s important that we are on the same page when working together.
Throughout this Agreement, Michael J Chudzik and Vision Path Arts and Consulting will be referred to as the “Coach” (including other person(s) referred or assisting)
and YOU the Payer and/or coaching event participant will be referred to as ("Client"). 

 

RESPONSIBILITY
*Your Coach will do everytihing possible to support you in achieving your own results and desired outcomes.
*You are responsible for the cause of all change in your life.
*Your Coach will work with you to identify solutions and offer suggestions, options and advise based on their own personal experience, training and the information appropriate.
*You accept full responsibility for all decisions and courses of action.
*You as Client, by signing this Coaching Agreement agree and acknowledge that the coach is not a licensed investment adviser, real estate agent, accountant, finance, health or legal professional. The coach does not provide medical or psychological evaluation, analysis or therapy. Anything stated by the coach with regards to any of these maters referred above are strictly personal opinion.
*You as the Client, if you are undergoing any psychological counseling, therapy or taking any medication related to and intended to treat or improve your mental state of health should advise the coach so that they can be aware and become informed from you as how to not change, affect or undermine your counseling or treatment in any way. As the Client, you agree to contact your aforementioned health care professional for advice before discontinuing any treatment or medication throughout the course of this coaching.
*You as the client, are responsible at all times for your safety, health, well being and material possessions during live sessions or events.

CONFIDENTIALITY
Your Coach will not divulge that you are in a coaching relationship without your express consent. You, of course are free to discuss the coaching relationship with anyone at anytime.

 

SCHEDULING
All Coaching Sessions are scheduled in advance by direct agreement between you and your Coach. If for any reason you cannot attend a scheduled Coaching Session you are fully responsible for informing your Coach and arranging an appointment at least 48 hours in advance, otherwise the session will be deemed forfeit. You are responsible for rescheduling via phone or contact (and receive reply) via email or text. If a written notice is sent by email, you agree to call or text the coach to notify them at the time it is sent.

 

TASKING
Tasks are assigned to assist in accelerating your change and the achievement of your desired results.

 

FREE EXTRA TIME
There is no extra charge for brief “between session calls” with your Coaching Sessions, whether to discuss an issue or concern or share something great! Your Coach provides this free additional service to give you superior support and results.

 

FREE EMAIL ACCESS
You can email and correspond with your Coach during the week to share wins, seek clarity on actions or review minor issues. Brief catch up emails are no charge.

PAYMENT AND REFUND TERMS AND CONDITIONS, AND OTHER - PLEASE READ CAREFULLY! 

These Terms and Conditions will be part of your agreement with Vision Path Arts and Consulting and Michael Chudzik.

When buying an item or service through Vision Path Arts and Consulting related to items or coaching services or events, including those marketed on or paid through it’s www.visionpath.org website, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for using our services / for our products are listed on the website or will be listed on an invoice to you. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.

The fee for the services and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged on a monthly basis to your payment method.

CANCELLATION PERIOD - Upon any payment for service, you may cancel the agreement and payments in writing by email within 5 calendar days of the date of executing both the Agreement and the payment for a full 100% refund of any monies paid LESS the cost of any credit card charges levied against the coach, or any products, services, rents or transportation services that have already been delivered or purchased on the client’s direct behalf of their services or sessions.
This refund is also only available if services have not commenced in any way rendering any refund void. 
Notice of cancellation shall only be deemed sent by written email addressed to coach’s email michael@visionpath.org. Cancellation notice will be deemed delivered on the date in which the cancellation is received by coach.

No refunds, credits or transfers available for no-shows.

​

Suspension of coaching or membership is possible after your program is in progress, but there will be no refunds given if requested. If you are enrolled in continuing coaching for a number of sessions, unused sessions due to leaving the program may not be eligible for refund, credit or transfer – but MAY be credited only if client is notified in writing to future coaching sessions at the sole discretion and approval of the coach.

Payment Plans - If any installment payment should default, the Client will have seven (7) days to rectify the situation. Any scheduled coaching session(s) will be postponed until payment is received within the 7 days, all discounts and bonuses will be forfeited and full payment will apply. 
If a Client should default on any installment payment, the result may be cancellation from the Program and the Cancellation Policy will apply. An N.S.F. or credit card decline will result in penalty from our payment processing company, or collection rights for NSF-related fees and losses to the coach in cases of payment default.

 

Third Party Payments - Payment for coaching, events or services by a third party for the benefit of another person or persons considered to be the “coaching participant(s)/client(s)” will not negate the terms or conditions of this Agreement. If the party for whom the payment(s) were intended to benefit does not comply with all the terms of this agreement including dropping out of coaching, not showing up or showing up late, not giving the proper session cancellation time notice, or any other act that would cause the one who purchased the coaching, event or service a reason to request payment refund – all terms and conditions of this Agreement shall apply to both the payer and the coaching participant(s)/client(s) as one and the same. The payer, when reading this condition, should make the coaching participant(s)/client(s) aware of this condition and all of the Terms and Conditions BEFORE executing their payment for these services.

 

Mutual Agreement Cancellation - If at any time wither the Client or Coach believe the Coaching Sessions and agreement are no longer serving the needs of the Client they may initiate a discussion to rectify the situation prior to cancelling the Program or Sessions.

 

Program Changes - The Coach reserves the right to change, modify or cancel any programs, altar their course materials, or change locations as considered necessary and good for the improvement or benefit of the program, or due to time necessity, or caused by weather, fire conditions, or public safety.  Any such change will be made in consultation with the Client but is ultimately the decision of the coach, including decisions regarding refunds or time credits.

 

Snow, Fire, Natural Disaster and Health Events Related to Live Sessions or Events. In event of any of the above concerns, last minute changes may be necessary to cancel, end or terminate a session or event - in which case no refunds will be given and the amount of time in that session or event will be credited forward either as a rescheduled session or event, or credited to the client toward future coaching or events, by mutual consent of both parties.

Intellectual Property - All material relating to the Program is subject to copyright and other intellectual property rights. Written materials, electronic documents, or website pages that are distributed or made available during coaching, are considered copyright property of Michael J. Chudzik and are created and sold with coach’s intention not be altered and republished or distributed without written consent of Michael J Chudzik, unless that material is already the copyright property of another party. No materials may be recorded, used or reproduced without the written permission of the owner. 

 

Termination of Service - The coach may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment 

Indemnification - You understand that all action taken is performed voluntarily and is your own responsibility. Clients should seek independent professional advice before undertaking any physical, business or investment actions. You agree to indemnify and hold Michael Chudzik and Vison Path Arts and Consulting harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with any of the services offered on the website or in other forms of invitation or solicitation.

 

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of [Name of Country / State], without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Siskiyou County, California. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded. 

 

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service. 

 

Agreement, Terms and Condition Considered Approved Upon Signature or Payment - 
By entering into a Coaching Agreement either through signing a Coaching Agreement with Vision Path Arts and Consulting or paying any amount to your coach, you are agreeing to abide by these terms and conditions as set out above.
